Xavier Batten of Brooksville Florida was arrested Friday and is being held in custody according to prosecutors. He is charged alongside Chance Brannon a yearold activeduty Marine stationed at Camp Pendleton and Tibet Ergul of Irvine California. All three men are charged with conspiracy and malicious destruction of property by fire and explosion each of which carries between five and years in prison. Brannon has pleaded not guilty according to his lawyer Kate Corrigan. Erguls lawyer did not immediately respond to a request for comment but was also scheduled to be arraigned Monday. On March prosecutors said the two threw the Molotov cocktail at the door of the clinic. The Planned Parenthood was forced to close the next morning and cancel around appointments.Previously reported that nobody was injured in the attack. The US Marine Corps previously declined to comment to citing the ongoing legal matter. The Justice Department said that two men wearing hooded sweatshirts and face masks approached the Planned Parenthood facility at approximately a.m. the day of the attack ignited a device and threw the flaming device at the front door. The release quotes court documents saying that the device landed against a southern wall next to the glass door and erupted into a fire which spread up the wall and across the ceiling above the glass doors. The attack was captured on security videos. The Defense Department said the men identified which building they wanted to attack and bought materials to assemble a Molotsov cocktail. The firebombing took place on a Saturday morning in March and the clinic was closed the next day. It has been reported that no one was injured during the attack and no one has been identified as the target of any of the attacks so far. The case is still under investigation and no charges have been filed against Batten or the other two men in relation to the attack on the Planned Planned Parenthood clinic in California last spring. It is not known if the men will face any charges in connection to the firebomb attack that occurred on March 23, 2014. The California Department of Health and Human Services has not commented on the case. The Department of Justice said that it is investigating the incident and is working with local law enforcement to determine the cause of the fire that broke out at the California Planned Parenthood building in March. It was reported that the fire was caused by a homemade explosive device that was thrown from a passing car and ignited on the inside of the building. The building was closed for the day and later closed again the following day for the remainder of the day. The clinic was forced. to close. around appointments and canceled around appointments for the rest of the week. The U.S. Marine Corps has declined to. comment on the matter, citing an ongoing legalmatter in which the Marine Corps is involved. The DOJ said that Brannon and ErgUL are facing additional charges for possession of an unregistered destructive device.
