Washington Attorney General Merrick Garland did not provide a robust explanation on Friday for why he needed to give US attorney David Weiss special counsel status for the Hunter Biden probe . The simplest explanation is that the plea talks between Weiss and Hunter Biden over tax and gun charges have collapsed and the case now appears to be headed to trial . It is extraordinary for the Justice Department which is part of the executive branch to go to trial against the son of a sitting president . Politics is also hanging over the investigation especially emanating from Capitol Hill . House Republicans are investigating the claims from the IRS whistleblower and are asking questions about how Hunter Biden nearly walked away with what they call a sweetheart deal . The IRS whistleblowers told Congress they wanted to interview Biden family members after finding financial improprieties in Hunter Bidens tax records but were blocked by Justice Department officials . But there is no public indication that this is the case . The new role as special counsel could put all of that on ice . It will be much easier now for the DOJ to do what it often does to swat away oversight requests because of an ongoing investigation . The House Judiciary Committee is seeking interviews with nearly a dozen Justice Dept. officials who were involved in the investigation . But Weiss has already committed to appearing at a public hearing this fall. He also has sought testimony from Weiss . He previously committed to appear at a private hearing this month.
