Texas Attorney General Ken Paxton is suing the Biden administration for allegedly cutting concertina wire at the USMexico border . The Biden administration and Texas have been at odds in recent months over how to handle border security . Last month Border Patrol apprehended more than migrants crossing the US Mexico border the highest total during a one month period this year . Texas has the sovereign right to construct border barriers to prevent the entry of illegal aliens the attorney general said in the lawsuit . The defendants include the Department of Homeland Security DHS Secretary Alejandro Mayorkas US Customs and Border Protection CBPs acting commissioner Troy Miller US Border Patrol USBPs Chief Jason Owens and USBP Del Rio Sector acting chief patrol agent Juan Bernal . The lawsuit comes amid an increase in apprehensions at the southern border . Texas approach to deterring migrants which includes deploying floating barriers in the Rio Grande has come under fire in the past months . In July the Justice Department sued Texas claiming that the buoys were installed unlawfully and asked the judge to force the state to remove them from the border .
