Scott Smith was charged with obstruction of justice and disorderly conduct for his behavior at a school board meeting shortly after his yearold daughter was assaulted in her schools bathroom in Ashburn Virginia . Smith was convicted of both charges in . Smiths conviction for resisting arrest was later dismissed and he eventually received a suspended sentence of days in jail . Republican Gov. Glenn Youngkin pardoned Smith on Friday . Smith said he believes that in todays America getting a fair and free trial is next to impossible in today’s America . The case helped fuel a national political conversation around school choice and parental rights . Conservative media in particular highlighted the sexual assault case in an effort to promote antitransgender talking points . Youngkin leaned heavily on these issues during his gubernatorial campaign vowing on election night were going to embrace our parents not ignore them. Smith said I think its pretty clear and convincing to the public that what happened to me that day should have never happened. Im glad that this is finally over. I am pleased that this was finally over and I am glad that the experience has led him to believe that in today getting a free and a fair trial is over and over, he added. Smiths arrest at the school board meetings helped fuel the national conversation about school choice, school choice or parental rights and parental protection. Youngkin said he is pleased to grant Smith this pardon. He said he was pleased to give him this pardon and help him and his pardon. Im pleased to acknowledge that he and his wife and his mother and his parents have been able to have the opportunity to have a safe place to have their children back and their children are back and back again.
